Terms of Service

1. Acceptance of these terms
These Terms of Service (the "Terms") are a binding agreement between you and DATAFRUIT LLC, the operator of resumonster.ai and the Resumonster service (the "Service", "we", "us", "our"). By creating an account, clicking to accept, or using the Service, you agree to these Terms and to our Privacy Policy, which is part of these Terms. If you do not agree, do not use the Service.
2. Who can use Resumonster
You must be at least 18 years old and able to form a binding contract to use the Service. By using it, you confirm that you meet these requirements. The Service is not intended for children, and we do not knowingly collect personal information from anyone under 13. If you believe a child has used Resumonster, contact us and we will delete the information.
3. Your account
You are responsible for keeping your login details confidential and for everything that happens under your account. Provide accurate information when you sign up and keep it current. Accounts are personal to one individual. You may not share, sell, transfer, or let anyone else use your account, and you may not use one account to serve several people. Tell us at hello@resumonster.ai if you think someone has accessed your account without permission. We may suspend or limit an account we reasonably believe is being shared or misused.
4. What Resumonster does
Resumonster helps you tailor a resume you already have to a specific job posting. You provide your resume template, your career information, and a job posting, and the Service uses artificial intelligence to generate a tailored resume in your template, which you can download as a PDF. To provide the Service, we send your content to our AI provider, Anthropic, which processes it to generate your output. We may add, change, or discontinue features over time. Output is generated by AI and may contain errors, so you are responsible for reviewing it before you use it.
5. Subscriptions, billing, and cancellation
Plans and billing. We offer Free, Basic, and Pro plans. Paid plans are billed through our payment processor, Stripe, on a monthly or quarterly cycle that you choose at checkout.
Automatic renewal. Paid plans renew automatically at the end of each billing period at the then-current price, and your payment method is charged, until you cancel. You agree to this automatic renewal when you subscribe.
Cancellation. You can cancel at any time from your billing settings in the app, using the same account you used to subscribe. Cancellation takes effect at the end of your current paid period. You keep access until then, and you are not charged again after that. We do not provide refunds or credits for partial periods.
Changing your plan. If you upgrade, the change takes effect immediately and we charge a prorated amount for the rest of the current period. If you downgrade, the change takes effect at the end of your current period.
No refunds. Except where required by law, all charges are final and non-refundable, and we do not offer a money-back guarantee.
Price changes. We may change prices or plan features. If a change affects your recurring charge, we will notify you in advance as required by law, and the new price applies to your next renewal. If you do not agree, you can cancel before the change takes effect.
Fair use. "Unlimited" features are unlimited for one person's normal job-search use, subject to fair use. We currently apply a ceiling of 300 resume generations per calendar month, and we may review or limit accounts whose automated or shared usage far exceeds what a single person could reasonably need. If you have a legitimate high-volume need, contact us and we will find a plan that fits.
6. Acceptable use
You agree not to:
- use the Service for anything unlawful or to infringe anyone's rights;
- upload another person's resume, personal information, or content unless you have their permission and the right to do so;
- create or submit resume content you know to be false or fraudulent, including fabricated employers, dates, degrees, licenses, or credentials;
- scrape, crawl, or use bots or automated means to access the Service, or place an unreasonable load on it;
- reverse engineer, decompile, probe, or attempt to discover the Service's source code or models, or bypass usage limits, paywalls, or security;
- resell, sublicense, rent, or provide the Service to others, or use one account for multiple people;
- upload malware or interfere with the Service or with other users; or
- use the Service or its output to develop or train a competing product or model.
We may investigate suspected misuse and may suspend or terminate accounts that break these rules.
7. Your content and the license you give us
You own your content. You keep all rights to the resume, career information, job postings, and other materials you upload ("Your Content"), and to the tailored resumes the Service generates for you. We do not claim ownership of them.
License to run the Service. You give us a limited, non-exclusive, worldwide, royalty-free license to host, store, process, transmit, and display Your Content, and to create tailored output from it, only as needed to operate and provide the Service to you. This includes sharing Your Content with the service providers we use to run the Service, including our AI provider, Anthropic, which processes it to generate your output. Under Anthropic's commercial terms, your content is not used to train its models.
Your responsibilities. You confirm that you own or have the right to submit Your Content, that submitting it does not violate anyone's rights, and that you will not upload another person's information without permission. You are responsible for the accuracy and truthfulness of Your Content and of any resume you create and send to employers.
This license ends when you delete Your Content or close your account, except for content already sent to service providers, standard backups, and anything we must keep as described in our Privacy Policy.
8. Our intellectual property
The Service, including the Resumonster name, logo, website, software, and design, is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, personal, non-transferable, revocable license to use the Service for its intended purpose while these Terms are in effect. All rights not expressly granted are reserved. If you send us feedback or suggestions, we may use them without any obligation to you.
9. AI output and no guarantee of results
The Service uses artificial intelligence to generate resumes. AI output can be inaccurate, incomplete, outdated, or unsuitable for your situation. You are responsible for carefully reviewing, editing, and verifying every resume before you use or submit it, and for making sure everything in it is true and accurate. The Service does not provide career, legal, financial, or professional advice.
We do not guarantee any particular result. Using the Service does not guarantee that you will get interviews, job offers, or employment of any kind. Any statistics or studies we reference come from third parties, describe other people's experiences, and are not a promise of your results.
10. Third-party services
The Service relies on third parties, including Stripe for payment processing, Anthropic for AI processing, and sign-in providers such as Google. Your use of those features is also subject to those companies' terms and privacy policies. Payments are handled by Stripe, and we do not store your full card details. We are not responsible for the acts, outages, or content of third-party services, but this does not limit our own responsibilities to you under these Terms.
11. Disclaimer of warranties
The Service is provided "as is" and "as available", without warranties of any kind. To the fullest extent allowed by law, we disclaim all implied warranties, including any implied warranty of MERCHANTABILITY, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service or its output will be accurate, complete, reliable, secure, uninterrupted, or error-free.
12. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, lost wages, lost job or business opportunities, lost data, or reputational harm, arising out of or relating to the Service or its output, even if we were told such damages were possible.
Our total liability for all claims relating to the Service is limited to the greater of the amount you paid us for the Service in the 12 months before the event giving rise to the claim, or fifty US dollars ($50).
Nothing in these Terms limits any liability that cannot be limited under applicable law.
13. Indemnification
You agree to defend, indemnify, and hold us harmless from claims, damages, and reasonable costs (including reasonable legal fees) that arise from Your Content, your use of the Service, your violation of these Terms or the law, or your infringement of anyone's rights. We may take over the defense of any such claim, and you agree to cooperate. This section does not apply to the extent a claim results from our own violation of law.
14. Suspension and termination
You can stop using the Service and cancel your plan at any time, as described in the billing section. We may suspend or terminate your access if you break these Terms, if we suspect fraud or account sharing, for non-payment, to comply with the law, or if we discontinue the Service. For serious violations we may act immediately; otherwise we will give reasonable notice where practical.
When your account ends, your right to use the Service stops. We handle your data after termination as described in our Privacy Policy, including how long we keep it and when we delete it. Sections that by their nature should survive, including the content license needed to wind down, intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution, will survive termination.
15. Changes to these terms
We may update these Terms. When we make material changes, we will let you know by email or through the Service before they take effect, and we will update the date at the top of this page. If you keep using the Service after an update takes effect, you accept the updated Terms. If you do not agree, stop using the Service and cancel.
16. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute will be brought only in the state or federal courts located in Santa Clara County, California, and you and we consent to their jurisdiction. To the extent allowed by law, you and we waive any right to a jury trial and agree to bring claims only on an individual basis and not as part of a class or representative action. Either of us may still bring an eligible claim in small claims court.
